These are the most forgotten Americans, however, the conditions that many native Americans live under should be a cause for concern and a call-to-action when all the glitz and glamour *(see Footnote) fades because theirs is a cause that is truly deserving, having stood the test of time, not Johnny-come-lately types seeking a free ride without contributing anything meaningful). Opportunities can and should be inclusive for upholding such, whenever appropriate. This is a description about Native Americans tribal living conditions, which could be improved if some consideration is extended to these, the Forgotten a heritage to, which my outspoken Pen Pal and friend Lois shared with these forgotten types and conditions they all are subjected to, and from, which she like they need and deserves to be freed from the circumstances, in, which they have all found themselves due to no fault of their own, (see the post HONORING GOD AND RESPECTING OTHERS, PRACTICALLY). The article further documents that numerous studies have shown that when a trip through Western Reservation Country is taken, the effect of the system of insecure property rights are clearly visible with typically hundredths of over grazed tracks containing a shack unfit for human occupation but with the title more often than not held under the management of the DOI. By comparison, the article points out that in the same Reservation Country, when irrigated, cultivated, well-kept property is evident, such property is held in fee simple, whether by Indian or non-Indian. This process (land tenure) in Indian County dates back to the 19th century, which resulted in the placement of millions of acres of tribal and individual Indian land under the trusteeship of the DOI in a complicated legal process. As a result, these lands can’t be sold, used as collateral, easily inherited or managed productively. Empowering these “first Americans” by allowing them to manage their own land, borrow against it and make it more productive while reducing their dependence on Federal welfare aid is the fair thing to do and this Blogger agrees. This has been demonstrated in various instances where control of the lands has been “wrested” from the Agency’s control with very positive results. The following examples are a testament to this: in the Flathead Reservation in Montana, where tribal managed timber operation increased a staggering 640% after the change. Similarly, again in Montana, the Crow tribe negotiated a deal for a plant to convert coal to liquefied fuels (such as jet and diesel) that at the time of the article’s writing, had the potential to generate revenue of $1 billion (annually). With such a scenario, the potential increase in the per capita income of each tribal member stood to rise by over 1000%. These examples show clearly that when changes are enacted and tribal members are empowered, better living conditions result; thus reducing the burden on the Federal Government in times that are tough financially, even for the Federal budget.
The second area mentioned for advancing the cause of these forgotten “Americans”, strengthening the rule of law also have positive examples to show by comparison. The article emphasized that in those areas where reservations were placed under the State Jurisdiction in 1953, in all instances stronger legal systems have resulted than those remaining under tribal law and further review has confirmed this to be true. Those results depicted a 20% per capita income growth rate between 1969 and 1999 for tribes under state versus tribal jurisdiction.
As emphasized in the article, a stable legal system is essential for economic growth, which has not been the hallmark of tribal courts. The article then called for the establishing of a system of stricter standards for tribal courts to meet or risk forfeiting such rights to state courts if failure to meet such standards aren’t complied with. The implications for the Future:
Empowerment brings an increase in living standards because all tribal reservations are not in areas fortunate (or unfortunate) enough to benefit from gaming proceeds and alternate forms of empowerment are needed to assist these “first Americans” to be better able to be less dependent on Federal welfare aid or rely on gambling proceeds (and all the associated problems it attracts) to improve their standard of living. Some are of the opinion that being "free" is as simple as: 1) switching pawns around a chess board and 2) one size fits all. Switching pieces around a board by changing the color of the pieces does not constitute being "free" just because the player positions were changed just as the "liberating" of "first Americans" cannot be compared to any other group, individual(s), etc., because their situation is unique and can be compared to no other. Therefore with this clarification out of the way, the definition of "FREE" should be examined before it is used indiscriminately, because freedom for one, may very well be imprisonment for another as no two situations are alike. The solution offered stands as the best "long-term" approach for all whose "VITAL" interests were not previously considered beyond a few years, in my opinion and as such, it's unfair to "kick the issues of concern down the road while subjecting such to day-to-day thinking only". If given a chance to be the beneficiary of the "long-term" solution approach with regards to the cause at hand ONLY, while leaving the concerns of all else aside, it would be recognized that the turn-around approach has the best chance for eventual success than the short-term day-to-day practices enacted thus far. If the opinions of all (the affected at interest) are honestly sought for input what do you think would be the outcome of such a data gathering exercise, try it to give all whose "freedoms" are really at stake a voice in their collective outcome and let the matter rest there, instead of the present approach desired by one(some), wanting to be both intercessor and the recipient of the solution as well, because it (the solution) is not working out as expected.
